The use of preimplantation genetic diagnosis (PGD) has expanded both in number and scope over the past 2 decades. Initially carried out to avoid the birth of children with severe genetic disease, PGD is now used for a variety of medical and non-medical purposes. While some human studies have concluded that PGD is safe, animal studies and a recent human study suggest that the embryo biopsy procedure may result in neurological problems for the offspring. Given that the long-term safety of (...) PGD has not been clearly established in humans, this study sought to determine how PGD safety is presented to prospective patients by means of a detailed website analysis. The websites of 262 US fertility centres performing PGD were analysed and comments about safety and risk were catalogued. Results of the analysis demonstrated that 78.2% of centre websites did not mention safety or risk of PGD at all. Of the 21.8% of centres that did contain safety or risk information about PGD, 28.1% included statements highlighting the potential risks, 38.6% presented information touting the procedure as safe and 33.3% included statements highlighting potential risks and the overall safety of the procedure. Thus, 86.6% of PGD-performing centres state that PGD is safe and/or fail to disclose any risks on their websites despite the fact that the impact of the procedure on the long-term health of offspring is unproven. This lack of disclosure suggests that informed consent is inadequate; this study examines numerous factors that are likely to inhibit comprehensive discussions of safety. (shrink)

In 1971, Günter Blobel and David Sabatini proposed a novel and quite speculative schematic model to describe how proteins might reach the proper cellular location. According to their proposal, proteins destined to be secreted from the cell contain a “signal” to direct their release. Despite the fact that Blobel and Sabatini presented their signal hypothesis as a “beautiful idea” not grounded in experimental evidence, they received criticism from other scientists who opposed such speculation. Following the publication of the 1971 model, (...) Blobel persisted in conducting experiments and revising the model to incorporate new data. In fact, over the period of 1975–1984, Blobel and colleagues published five subsequent schematic models of the signal hypothesis, each revised based on new laboratory evidence. I propose that the original 1971 model can be viewed as an epistemic creation. Additionally, analysis of the subsequent schematic diagrams over the period of 1975–1984 allows one to track Blobel’s changing conception of an epistemic object over time. Furthermore, the entire series of schematic diagrams presented by Blobel from 1971 to 1984 allow one to visualize the initial conception and subsequent reworking of a scientific theory. In 1999, Blobel was awarded the Nobel Prize in Physiology or Medicine for his work on the signal hypothesis, which was ultimately supported by experimental evidence gathered after the speculative model was published. The U.S. government began investing heavily in biotechnology research in the 1980s, and by 1987 had spent approximately $2.7 billion to support research and development, including $150 million for agricultural biotechnology. The approximately sixty U.S. biotechnology companies invested $3.2 billion in R and D in 1991 alone, with a total of more than $10 billion spent since the industry began in (...) the late 1970s. Women are underrepresented in the upper echelons of management in most countries. Despite the effectiveness of identity conscious initiatives for increasing the proportion of women, many organizations have been reluctant to implement such initiatives because potential employees may perceive them negatively. Given the increasing competition for labor, attracting talent is relevant for the long-term success of organizations. In this study, we used an experimental design to examine the effects of identity blind and identity conscious gender diversity initiatives on people’s pursuit (...) intentions toward organizations using them. We used counterfactual thinking, derived from fairness theory, as a guiding framework for our hypothesis development and investigated the moderating influence of a forthcoming government-mandated gender quota as well as individual characteristics. Participants reviewed statements regarding workplace diversity initiatives and rated either the initiatives’ effectiveness or indicated their intentions to pursue employment with organizations using them. Of those rating pursuit intentions, half were informed that the country in which they were conducting their job search was about to implement gender quotas. Results indicated a diversity management paradox such that initiatives perceived as more effective made organizations using them less attractive as employers. However, these negative perceptions were mitigated by a government-mandated quota, and also lower among women. Implications for the study and practice of diversity are discussed. (shrink)

Although establishing gender equality in board and managerial positions has recently become more important for organizations, companies with low levels of gender diversity seem to perceive an ethical dilemma regarding the ways, in which they attempt to attain it. One way that organizations try to move toward gender equality is through the use of their corporate websites to manage potential applicants’ impressions of their current levels of, and actions to improve, gender diversity. The dilemma is whether to truthfully communicate their (...) low level of gender diversity, conceal it, or exaggerate it. On the one hand, organizations that are truthful may find it difficult to achieve equality because women are less attracted to companies that lack diversity. On the other hand, organizations that are untruthful risk their moral legitimacy. The present work investigates gender diversity-related communication on the corporate websites of 99 major German companies. Based on theoretical work on minority attraction, we apply an organizational impression management taxonomy to guide our in-depth content analysis. With this approach, we hope to advance the understanding of how the issue of gender diversity is presented on corporate websites, which is useful for both organizational decision makers as well as diversity researchers. We found that although gender diversity-related communications on corporate websites contain both assertive and defensive organizational impression management tactics, as well as a third type of tactic we refer to as “acknowledgement,” assertive tactics were used more frequently. We argue the existence of a paradox whereby organizations use assertive impression management tactics to maintain pragmatic legitimacy but compromise their moral legitimacy by doing so. Furthermore, we argue that moral legitimacy can be maintained or restored through the sincere use of defensive impression management tactics and acknowledgement. (shrink)

We thank the commentators for their thoughtful responses to our article.1 Due to space constraints, we will confine our discussion to just three key issues. The first issue relates to the central ethical conundrum for clinicians working with young people like Phoenix: namely, how to respect, value and defer to a person’s own account of their identity and what is needed for their well-being, while staying open to the possibility that such an account may reflect a work in progress. This (...) conundrum thus relates both to what will be beneficial for that person and what constitutes respecting their autonomy, and clinicians must dwell on these questions when deciding what forms of medical intervention to offer. D’Angelo,2 Lemma3 and Wren4 highlight the importance of considering Phoenix as a ‘whole person in context’ 2 prior to initiating treatment or care. In this way, they advocate for a process of ‘therapeutic exploration’,4 which includes taking sufficient time to explore Phoenix’s personhood with them so as to support them in achieving an ‘authentic self-discovery’.2 We agree with these authors that identity development is a complex, life-long process that is influenced by biological, psychosocial and relational aspects, all of which may contribute to an individual’s desire to pursue gender-affirming interventions. To explore the various factors—both conscious and unconscious—that might be motivating Phoenix’s decision to pursue ongoing puberty suppression, D’Angelo,2 Lemma3 and Wren4 describe a comprehensive psychological approach to working with transgender and gender diverse individuals and propose questions to guide such discussions. Consistent with this approach, we stipulated that Phoenix had undergone regular psychological counselling and that the psychologist had judged that ‘Phoenix’s distress is significant and enduring…not a symptom …. In this article, we analyse the novel case of Phoenix, a non-binary adult requesting ongoing puberty suppression to permanently prevent the development of secondary sex characteristics, as a way of affirming their gender identity. We argue that the aim of OPS is consistent with the proper goals of medicine to promote well-being, and therefore could ethically be offered to non-binary adults in principle; there are additional equity-based reasons to offer OPS to non-binary adults as a group; and the ethical defensibility (...) of facilitating individual requests for OPS from non-binary adults also depends on other relevant considerations, including the balance of potential benefits over harms for that specific patient, and whether the patient’s request is substantially autonomous. Although the broadly principlist ethical approach we take can be used to analyse other cases of non-binary adults requesting OPS apart from the case we evaluate, we highlight that the outcome will necessarily depend on the individual’s context and values. However, such clinical provision of OPS should ideally be within the context of a properly designed research study with long-term follow-up and open publication of results. (shrink)

In December 1984 Angela Weir and Elizabeth Wilson, two founding members of Feminist Review, published an article assessing contemporary British feminism and its relationship to the left and to class struggle. They suggested that the women's movement in general, and socialist-feminism in particular, had lost its former political sharpness. The academic focus of socialist-feminism has proved more interested in theorizing the ideological basis of sexual difference than the economic contradictions of capitalism. Meanwhile the conditions of working-class and black women have (...) been deteriorating. In this situation, they argue, feminists can only serve the general interests of women through alliance with working-class movements and class struggle. Weir and Wilson represent a minority position within the British Communist Party (the CP), which argues that ‘feminism’ is now being used by sections of the left, in particular the dominant ‘Eurocommunist’ left in the CP, to justify their moves to the right, with an accompanying attack on traditional forms of trade union militancy. Beatrix Campbell, who is aligned to the dominant position within the CP, has been one target of Weir and Wilson's criticisms. In several articles from 1978 onwards, and in her book Wigan Pier Revisited, Beatrix Campbell has presented a very different analysis of women and the labour movement. She has criticized the trade union movement as a ‘men's movement’, in the sense that it has always represented the interests of men at the expense of women. And she has described the current split within the CP as one extending throughout the left between the politics of the ‘old’ and the ‘new’: traditional labour movement politics as against the politics of those who have rethought their socialism to take into account the analysis and importance of popular social movements – in particular feminism, the peace and anti-racist movements. In reply to this debate, Anne Phillips has argued that while women's position today must be analysed in the context of the capitalist crisis, it is not reducible to the dichotomy ‘class politics’ versus ‘popular alliance’. Michèle Barrett, in another reply to Weir and Wilson, has argued that they have presented a reductionist and economistic approach to women's oppression, which caricatures rather than clarifies much of the work in which socialist-feminists have been engaged. To air these differences between socialist-feminists over the question of feminism and class politics, and to see their implications for the women's movement and the left, Feminist Review has decided to bring together the main protagonists of this debate for a fuller, more open discussion. For this discussion Feminist Review drew up a number of questions which were put to the participants by Clara Connolly and Lynne Segal. (Michèle Barrett was present in a personal capacity.) They cover the recent background to socialist-feminist politics, the relationship of feminism to Marxism, the role of feminists in le ft political parties and the labour movement, the issue of racism and the prospects for the immediate future. This essay attends to the place of virginity at the center of the fourth volume of Michel Foucault’s History of Sexuality, Confessions of the Flesh. Reading virginity through a rhetorical lens, the essay argues for an ethics and a politics of counter-conduct in Foucault characterized by chiasmus, a rhetorical structure of inverted parallelism. That chiastic structure frames Foucault’s Confessions, and all of his work, as a fragmented, self-hollowing speech haunted by death and the dissolution of the subject. The essay reads (...) Foucault as apophatic speech that returns to us, no longer itself, made strange. In that deathly movement of eternal recurrence, Foucault’s Confessions speak after death from the x’d out place of the queer virgin: on a threshold that separates life from death, in a movement of metanoia or ethical conversion. As an unfinished history in fragments, the essay’s form brings attention to incompletion as a crucial aspect of Foucault’s work. The fragmentation that characterizes an unfinished history underscores poetic discontinuity as the hallmark of Foucault’s genealogical method and thought. (shrink)

Lynne Huffer's ambitious inquiry redresses the rift between feminist and queer theory, traversing the space of a new, post-moral sexual ethics that includes pleasure, desire, connection, and betrayal. She begins by balancing queer theorists' politics of sexual freedoms with a moralizing feminist politics that views sexuality as harm. Drawing on the best insights from both traditions, she builds an ethics centered on eros, following Michel Foucault's ethics as a practice of freedom and Luce Irigaray's lyrical articulation of an ethics of (...) sexual difference. Through this theoretical lens, Huffer examines everyday experiences of ethical connection and failure connected to sex, including queer sexual practices, sodomy laws, interracial love, pornography, and work-life balance. Her approach complicates sexual identities while challenging the epistemological foundations of subjectivity. She rethinks ethics "beyond good and evil" without underestimating, as some queer theorists have done, the persistence of what Foucault calls the "catastrophe" of morality. Elaborating a thinking-feeling ethics of the other, Huffer encourages contemporary intellectuals to reshape sexual morality from within, defining an ethical space that is both poetically suggestive and politically relevant, both conceptually daring and grounded in common sexual experience. BackgroundThe ARRIVE (Animal Research: Reporting of In Vivo Experiments) guidelines are widely endorsed but compliance is limited. We sought to determine whether journal-requested completion of an ARRIVE checklist improves full compliance with the guidelines.MethodsIn a randomised controlled trial, manuscripts reporting in vivo animal research submitted to PLOS ONE (March–June 2015) were randomly allocated to either requested completion of an ARRIVE checklist or current standard practice. Authors, academic editors, and peer reviewers were blinded to group allocation. Trained reviewers performed outcome adjudication (...) in duplicate by assessing manuscripts against an operationalised version of the ARRIVE guidelines that consists 108 items. Our primary outcome was the between-group differences in the proportion of manuscripts meeting all ARRIVE guideline checklist subitems.ResultsWe randomised 1689 manuscripts (control: n = 844, intervention: n = 845), of which 1269 were sent for peer review and 762 (control: n = 340; intervention: n = 332) accepted for publication. No manuscript in either group achieved full compliance with the ARRIVE checklist. Details of animal husbandry (ARRIVE subitem 9b) was the only subitem to show improvements in reporting, with the proportion of compliant manuscripts rising from 52.1 to 74.1% (X2 = 34.0, df = 1, p = 2.1 × 10−7) in the control and intervention groups, respectively.ConclusionsThese results suggest that altering the editorial process to include requests for a completed ARRIVE checklist is not enough to improve compliance with the ARRIVE guidelines. Other approaches, such as more stringent editorial policies or a targeted approach on key quality items, may promote improvements in reporting. (shrink)

Michel Foucault was the first to embed the roots of human sexuality in discipline and biopolitics, therefore revolutionizing our conception of sex and its relationship to society, economics, and culture. Yet over the past two decades, scholars have limited themselves to the study of Foucault's _History of Sexuality_, volume 1 paying lesser attention to his equally explosive _History of Madness_. In this earlier volume, Foucault recasts Western rationalism as a project that both produces and represses sexual deviants, calling out the (...) complicity of modern science and the exclusionary nature of family morality. By reclaiming these deft moves, Lynne Huffer teases out exciting new strands of Foucauldian thought. She then revisits the theorist's ethical work in light of these discoveries, divining an ethics of eros that sees sexuality as a lived experience we are repeatedly called on to remember. Throughout her study, Huffer weaves her own experiences together with Foucault's, sampling from unpublished interviews and other archived materials in order to intimately rework the problem of sexuality as a product of reason. This two-part article summarizes the major arguments of Lynne Huffer’s 2010 book, Mad for Foucault: Rethinking the Foundations of Queer Theory. The second part of the piece is a dialogue between Huffer and feminist theorist Elizabeth Wilson about the implications of the book’s arguments about rethinking queer theory, interiority, psychic life, lived experience and received understandings of Michel Foucault’s work.

Recent historical work on changing perceptions of the human body has been influenced by Michel Foucault’s contention that the self of western individualism was created by new regimes of disciplining the body. A different approach is taken here, one that focuses on how individual bodies came to be viewed as separate and inviolable, that is, as autonomous. The separateness and inviolability of bodies can be traced in the histories of bodily practices as different as portraiture and legal torture. After 1750, (...) regular public exhibitions, themselves a new feature of the social landscape, showed increasing numbers of portraits in London and Paris. The proliferation of individual likenesses encouraged the view that each person was an individual, that is, single, separate, distinctive and original. At the same time, the tide turned against judicially sanctioned torture and cruel punishment. Long-held notions of sacrificial punishment and truth through pain withered under the pressure of new experiences of the body that in turn facilitated the emergence of new conceptions of rights of individuals. As part of recent epistemic challenges to democracy, some have endorsed the implementation of epistemic constraints on voting, institutional mechanisms that bar incompetent voters from participating in public decision-making procedures. This proposal is often considered incompatible with a commitment to political equality. In this paper, I aim to dispute the strength of this latter claim by offering a theoretical justification for epistemic constraints on voting that does not rest on antiegalitarian commitments. Call this the civic accountability justification for epistemic constraints (...) on voting. On this view, voters stand to one another in a normative relation of reciprocal accountability that requires them to uphold an epistemically responsible conduct. Modest epistemic constraints on voting are justifiable because they secure that participation in voting is conforming to this normative requirement. Thanks to its distinctive features, the civic accountability justification can overcome two problems that egalitarians commonly associate with the idea of epistemic constraints on voting: the disrespect problem and the hierarchy problem. This paper extends the analysis of liberal principles in social choice recently proposed by Mariotti and Veneziani (2009a) to infinitely-lived societies. First, some novel characterisations of inegalitarian leximax social welfare relations are derived based on the Individual Benefit Principle (IBP), which incorporates a liberal, non-interfering view of society. This is surprising because the IBP does not explicitly incorporate any preference for inequality, nor does it assign priority to well-off members of society. Second, some impossibility results are derived that highlight a (...) general tension between standard fairness and efficiency axioms in social choice, and a liberal Principle of Non-Interference that generalises IBP. Moreover, it provides an apparatus of references to the relevant literature produced by Rescher s critics, and positions his work in (...) the wider setting of its links with various contemporary American and European philosophers. The mixture of pragmatism and idealism, typical of Rescher s stance, is carefully taken into account, along with his contributions to logic, philosophy of science, metaphysics, theory of knowledge, ethics, social and political philosophy.". Em minha tese de doutorado defendi que, para compreender como Hegel articula a passagem da contradição dialética à lógica, o conceito hegeliano de contradição deve ser analisado sob a perspectiva de uma antinomia. Para sustentar este argumento, propus uma atualização deste conceito a partir de uma estrutura antinômica. Essa atualização, porém, trouxe um outro problema: nessa reconstrução, a contradição, em Hegel, continua a se desenvolver de maneira gradativa, ao passo que a lógica tradicional trabalha apenas com valores de p e (...) -p, e não com níveis de gradação. Assim, para continuar sustentando o argumento de que o conceito hegeliano de contradição, sob a perspectiva de uma antinomia, pode ser compreendido como uma contradição lógica, seria necessário encontrar uma lógica que não operasse apenas com valores binários, mas também com níveis de gradação. Foi a partir dessa necessidade que surgiu a ideia de aplicar o conceito de contradição em Hegel à Lógica Difusa, e esta é, portanto, a proposta do presente artigo. (shrink)

Lewis remarked in 1959, “it was taken for granted that the business of the artist was to delight and instruct his public”: that is to say, to address simultaneously their passions and their intellects. “There were, of course, different publics.... (...) And an artist might lead his public on to appreciate finer things than they had wanted at first; but he could do this only by being; from the first, if not merely entertaining, yet entertaining, and if not completely intelligible, yet very largely intelligible.” This constraint—let us call it intelligent (or purposeful) design, in keeping with a basic analogy that we will draw upon in these pages—had however been lost, Lewis observed. Hence, even “in the highest aesthetic circles one now hears nothing about the artist’s duty to us. It is all about our duty to him. He owes us nothing; we owe him ‘recognition,’ even though he has never paid the slightest attention to our tastes, interests, or habits.”1 In short, the artist of modernity need not pay the slightest attention to an intention, not even his own. Modern art need not be an expression of intelligence or [End Page 363] understanding; it is expression as such (tout court): personal and autonomous.2Lewis’s remarks do not point merely to the increasingly relativist tendencies of art in the Western world, to the lack of objective criteria or norms governing the artistic disciplines. They also point to the growing disregard among artists for the sociocultural expectations of their publicum. Mediating between the two is, without a doubt, the basis upon which both artistic and social norms were traditionally founded: nature, which served as a classic analogy for both art (understood in the broad sense, so as to include not only the fine arts, but also technology and practical sciences) and ethics in virtue of nature’s intrinsic inclination towards its defining end and perfection.With regard to the first of these analogies (that of art and nature), Mark Schiefsky explains that although art does bring about “results that nature itself cannot,” it does so in the classic understanding “by acting in a natural way—the way nature would act if it could generate the products of art.”3 As for the difference between the two, nature is moved to its specifying end by way of intrinsic inclinations that are implicit to it, whereas a work of art is moved to its end extrinsically, and thus with more or less violence.4 A sculptor, for example, who introduces a form into a piece of marble, does so by chiseling [End Page 364] and hammering away at the fine stone.5 “Art is,” Aristotle explains, “the principle and form of the thing that comes to be [let us say, a sculpture]; but it is located elsewhere [in, for example, the artist’s mind or in a sketch that he has made] than in that thing, whereas the movement of nature is located in the thing itself that comes to be [a tree, for example, or a baby], and is derived from another natural organism [a tree or human parents] which possessed the form in actuality.”6This classic distinction between art and nature parallels the distinction between art and ethics. Ethics “does not affect human action in the same way as do art and technique,” Servais Pinckaers explains. Unlike art and technique, which are concerned with “the external work produced by human action”—this painting or that machine, for example—ethics is concerned with an immanent principle, qualifying the actor as such: the stable dispositions (or habitus: virtues or vices) at the origin of “the active willing that is the principle source of the action.”7 This immanent principle at the source of ethical action is—to complete our analogy—creative in only a limited sense. At Outlines of Pyrrhonism (PH) 2.227–8, Sextus Empiricus argues that certain entities which his adversaries hold to be one and the same for different individuals are in fact not. This he does by, among other things, considering the truth-value of sentences of which the subject is a common noun, thereby drawing an interesting connection between metaphysics and semantics. In this article, I provide a careful analysis of Sextus’ arguments at PH 2.227–8 and explore the origins and limits of such a (...) connection. In particular, I argue that Sextus’ argument at PH 2.227 probably reflects a Stoic argument against Aristotelian essences, thereby relying on specifically Stoic doctrines about universals and common nouns, whereas his next argument at PH 2.228 targets accidents. If this is true, it follows that the overall structure of PH 2.227–8 fits well with the typically Aristotelian distinction between essence and accident. (shrink)

This paper discusses the theories underlying Walter Gropius’ conception of science. Starting with “Is There a Science of Design?” written by Gropius in 1947, the influences of Ganzheitspsychologie and the New Look on Perception are traced. In particular, the contribution of Earl C. Kelley is analyzed. Subsequently, Gropius’ phenomenological approach, insights on expressive qualities, and the relationship between man- environment are discussed. Finally, the influences of Gestalt theory and spiritualistic psychology on Gropius’s conception of science and perception are outlined.

Albert the Great’s Aristotelian paraphrases (De animalibus, Parva Naturalia) are famous for their extensive use of medical doctrines. Their use is not unprecedented in other Albertinian works, though. This article tries to show how Albert’s early theological works (De homine, Commentarium super libros Sententiarum) provide crucial evidence to understand the rationale behind Albert’s integration of medico-philosophical doctrines into his mature works of natural philosophy. In the first place, the early works assert that medicine – at least, its theoretical part – (...) treats a natural body subject to a natural process (healing), a view that leads Albert in his mature works to consider (this part of) medicine as a part of natural philosophy. Secondarily, the article moves on to show how Albert’s selective attitude towards medical doctrines and his position on the Galenic-Aristotelian quarrels about generation and origin of veins date back to his De homine and are strongly – although not entirely – dependent on Avicennian zoology and medicine. I present a comparative and holistic method for qualitatively measuring sound ecological practice in chemistry. I consider chemicals developed and used by man from cradle to grave, that is, from the moment they are extracted from the earth, biomass, water or air, to their transportation, purification, mixing and elaboration in a factory, to their distribution by means of the market, to waste products both from the factory, packaging, transportations and by the consumer. I divide the locations of the ‘life’ of (...) the chemical into four spatio-temporal areas accordingly. I then use the ‘instituional compass’ method to determine a qualitative reading of the ecological soundness of the practice, where practice means the research, the adoption by industry and the distribution at scale on the market. The qualitative reading is in the form of an arrow on a trisected circle. The arrow holistically represents a table of data. The data can be economic, social or environmental. The arrow has a measurement: a degree and a length. The degrees, represent qualities spaning through: harmony, discipline and excitement. The length represents the importance, momentum or amplitude with which the quality is present. We use the compass method to compare the same product over time, or inter-substitutable, chemicals developed in different places, using different equipment or processes. La présente contribution met en évidence le rôle fondamental du principe de précaution dans l’élaboration et la mise en œuvre de l’Union bancaire. Trois piliers la composent, le Mécanisme de supervision unique, le Mécanisme de résolution unique et le Système unifié de protection des dépôts, reflètant en forme pyramidale une approche graduée du risque systémique. La montée en puissance de l’usage des technologies de gouvernance algorithmique pour traiter les opérations financières sur les marchés engendre de nouveaux types de risques, liés (...) à la vitesse et au volume inédits des ordres traités à l’intervention de robots. Pour tenter d’en désamorcer les dangers, les régulateurs ont recours au même type d’instruments automatisés, de manière à ajuster leur vitesse de réaction à celle des transactions à contrôler. Enfin, le phénomène de génération de monnaies privées par des mécanismes de cryptographie autocertifiés, telle la blockchain, en ce qu’ils cherchent à se passer de l’appareil d’État, représentent un défi pour la souveraineté des autorités en charge de politiques publiques, fondées sur un socle de légitimité constitutionnelle. Là encore, le principe de précaution invite à mettre en place une monnaie de même nature mais non affranchie de tout système juridique l’encadrant. Le processus est à l’étude au sein de l’Union européenne et de certains Etats membres, dont la France. (shrink)

I wish to prove in this article that Thomas Aquinas was a metaontological pluralist, i.e., that he held that there are many, non-equivalent and irreducible dependence relations in the universe. In this respect, I shall focus on Aquinas' doctrine of the four causes and on the dependence relationships between matter and form in material substances. Subsequently, I shall also reconstruct Aquinas' doctrines by explicitly appealing to metaontological pluralism. I shall explore two routes towards Aquinas' metaontological pluralism: one based on cases (...) of apparent mutual dependence and the other based on the asymmetry of natural priority. Finally, I shall provide two original interpretations of the doctrine of the four causes and of the dependence relationships between matter and form. Such interpretations will be based on the metaphysics of powers. In Section 1 I shall introduce metaontological pluralism and the two routes. In Section 2 I shall examine Aquinas' doctrine of the four causes. In Section 3 I shall provide an interpretation of that doctrine based on powers. In Section 4 I shall consider the dependence relationships between matter and form in material substances. In Section 5 I shall provide an interpretation of such relationships based on powers. A autora retoma a sua trajetória, o que aprendeu ao longo de mais de trinta anos, interessando-se pelas formas como seus contemporâneos leem (ou não leem). Com as reflexões de Michel de Certeau como referência teórica, ela lembra como se colocou ao lado dos leitores, esforçando-se para prestar atenção às suas formas de apropriação e representação de um livro, um texto escrito ou uma biblioteca. Narra como aprofundou a análise da importância da literatura desde a infância, construindo um espaço para (...) se descobrir e simbolizar sua experiência. Em seguida, ela conta como se interessou por experiências literárias compartilhadas que reuniam pessoas que tinham vivido muito distantes da cultura escrita: lugares de "educação informal", oficinas em que a leitura de obras literárias e a arte desempenhavam um papel fundamental, concebidos para vítimas de catástrofes, populações deslocadas, jovens desvinculados de grupos guerrilheiros ou paramilitares, dependentes químicos nas ruas, crianças vítimas de violência doméstica, mulheres com bebês em situação de extrema pobreza... Essas experiências são conduzidas por educadores que tentam fazer algo fora do contexto acadêmico tradicional, ou bibliotecários, promotores de leitura, às vezes psicólogos, artistas, narradores, etc. A autora analisa sua arte de fazer, considerando crianças, adolescentes (e também adultos) em sua dimensão sensível, psíquica, física e não apenas cognitiva. Por fim, ela relembra como refletiu sobre a transmissão cultural, debilitada em muitas famílias: quando a luta pela sobrevivência ou o trabalho ocupa o tempo cotidiano, as crianças perdem uma etapa importante para integrar os diferentes registros da língua. Essa etapa é aquela em que, desde muito cedo, alguém é iniciado no uso das palavras tão vital quanto "inútil", gratuito, muito próximo da vida, das sensações, das emoções, do prazer compartilhado; muito longe do controle e da qualificação. Tudo o que ela estudou a convenceu da importância da literatura, oral e escrita, que atende a uma necessidade antropológica. (shrink)

In causal inference, a variety of causal effect estimands have been studied, including the sample, uncensored, target, conditional, optimal subpopulation, and optimal weighted average treatment effects. Ad hoc methods have been developed for each estimand based on inverse probability weighting and on outcome regression modeling, but these may be sensitive to model misspecification, practical violations of positivity, or both. The contribution of this article is twofold. First, we formulate the generalized average treatment effect to unify these causal estimands as well (...) as their IPW estimates. Second, we develop a method based on Kernel optimal matching to optimally estimate GATE and to find the GATE most easily estimable by KOM, which we term the Kernel optimal weighted average treatment effect. KOM provides uniform control on the conditional mean squared error of a weighted estimator over a class of models while simultaneously controlling for precision. We study its theoretical properties and evaluate its comparative performance in a simulation study. We illustrate the use of KOM for GATE estimation in two case studies: comparing spine surgical interventions and studying the effect of peer support on people living with HIV. (shrink)

Institutional operability refers to the normative conditions governing the exercise of power of office that makes an institution work. Because institutional action occurs by the interrelated actions of the officeholders, a focus on institutional operability requires the analysis and assessment of the officeholders’ conduct in their institutional capacity. This article distinguishes two perspectives on operability: ‘outward’ and ‘inward.’ The outward view emphasizes predefined instructions for efficient execution, focusing on rule-following to achieve institutional purposes. The inward perspective highlights role-playing and reflective (...) engagement among officeholders to uphold an institution’s raison d’être. The inward perspective brings to the fore the relational aspect of institutional life and officeholders’ interrelated responsibility for guiding institutional action. (shrink)

This article highlights certain aspects of Rodolfo Sacco’s theoretical work on comparative law. Rather than offering an exhaustive discussion, it outlines key points in his intellectual journey to help the reader understand how certain themes gained prominence in his work. An outstanding figure in the comparative law community since the 1970s, he remained active until the end of his life, well into the twenty-first century. Through his many contributions to the field, Sacco took comparative law research in new directions. He (...) developed a more nuanced and complex analysis of the tasks of the comparative lawyer, elaborating an approach to comparison that does justice to the multiple components of all legal systems (“legal formants”) and their dynamics. We owe him a fine study of the silent, implicit dimensions of law that have a major impact on its application (“cryptotypes”), and a reflection on the relationship between law and language that shows how comparative law is deeply implicated in the process of translation.
